1. Use and Access. Acceptance of the General Terms and Conditions of Use.
These are the General Terms and Conditions of Use (“Terms and Conditions of Use”) for Internet users accessing the contents and services made available by TLP through its web site http://www.terminallaspalmas.com.ar (“Site”). When using this Site, the User agrees and accepts the following Terms and Conditions of Use.
TLP may, in the future, amend these Terms and Conditions of Use by publishing said amendments to these Terms and Conditions or by publishing new terms and conditions in the Site. The User acknowledges and accepts that use of the Site after publication of said amendments shall imply acceptance of the new and current terms and conditions. Therefore, TLP recommends that users visit this Site periodically to revise said terms and conditions of use.
In case the User refuses to accept, in the future, these Terms and Conditions of Use, or any amendment thereof, without any limitations or amendments, the User is kindly invited to exit this Site.
2. Duties and Liabilities of the User.
The User shall be responsible for the confidentiality and the use of the information provided by the User. The User shall use adequate security procedures and shall comply with any reasonable instruction given by the Site in order to secure the information confidentiality. Any instruction or acceptance executed under the User’s identification shall be interpreted as executed by the authorized user.
The User shall comply with all laws and regulations related to any of the products offered by the Site, and shall also comply with all reasonable instructions given by the Site.
Furthermore, the User is, and shall be, responsible for all data and information posted by the User to TLP, as shall be liable for the accuracy of the data furnished. TLP reserves the right to deregister the User’s application any time the User furnishes false data, notwithstanding any other actions permitted by the law.
3. Legal Notice on Intellectual and Industrial Property.
Any material published in the Site (including, without limitations, texts, pictures, images, drawings, audio and video clips, and any other material related to the service provided and/or created by TLP, including the Site) is protected by intellectual property rights held by TLP as owner or lawful Licensee. The User agrees not to do anything that may violate and/or infringe said intellectual property, and shall do their best to preserve and protect these rights.
The User accepts not to use the Site for any illegal purpose. TLP reserves the right to limit or cancel access to the Site if, at TLP´s opinion, any User uses the Site to violate any law or the rights of third parties or these Terms and Conditions of Use.
4. Exceptions and Exclusion of Guarantees.
The use of the Site shall be at the User’s exclusive risk. The contents of the Site, as well as the products and services offered by the Site are given “as is”, without any guarantee of any kind, either express or implied. TLP shall not be responsible for the mistakes and/or omissions in the information provided by the Site, its contents, and the products and services offered, as well as for any inconvenience arising from any violation of third parties´ rights.
TLP doest not give any guarantee, either express or implied, related to the fact that the material contained in the Site is not violating any third party’s rights; that access to the Site is without interruptions or mistakes; that the Site is secure; or that the information provided by the Site is complete, accurate and timely.
TLP doest not guarantee or secure that use of the Site, any software, service or contents by any User is not violating, or shall not violate, any rights of third parties, and that the provisions mentioned in this Clause 4 are accurate, complete or updated. Furthermore, in relation to any publication, presentation and any other similar elements that may be found in the Site, TLP shall not assume any liability in relation to the use of any illegal, threatening, false, misleading, abusive, intimidating, offensive, defamatory, vulgar, obscene, scandalous, provoking, pornographic or disrespectful material, or any other material that may be considered or induce a criminal conduct, bring about civil liability claims, or violate any other law, and which is included in any part of the Site.
5. Site Links
Links, websites or services of other companies may be offered through the Site. TLP does not control the contents, privacy policies or practices of websites owned by third parties, and shall not assume any liability on their behalf.
TLP is not associated with or affiliated to any website sponsors or producers linked to or from the site. TLP shall not support, represent or guarantee the contents of said sites.
Under no circumstances shall TLP be responsible for the availability or the contents of websites owned by third parties linked or not linked to the Site, or for the loss or damage the User may suffer as a consequence of said website availability and/or contents. Any comments and/or claims related to any website owned by third parties linked to the Site must be addressed to said website administrator.
TLP recommends that the User of the Site should read the terms and conditions and the privacy policy of all other sites they may visit.
6. Liability Limit.
The User shall use the Site or any software, service or material available through the Site, on the User’s own behalf and risk. Any recommendation and/or information, either oral or written, obtained by the User, as user of TLP or from the Site, does not create, and shall not create, any guarantee whatsoever.
Under no circumstances shall TLP be responsible for any damage suffered by third parties as a consequence of using the Site, its contents or the products and services offered by the Site.
TLP shall not be responsible for any failure, mistake, omission, interruption, loss of income, loss of information, loss of other intangible property and loss of information security provided, on line operation or transmission delays, viruses, system errors or any other kind of loss arising from the use of the Site. This limitation applies notwithstanding any claim of damages based on contractual liability due to negligence, and notwithstanding the negligence of our representatives or TLP, and even if they have been advised of the possibility of said damage.
Furthermore, neither TLP nor any of its directors, officers, agents, shareholders, licensors and representatives are or shall be responsible for any direct, consequential, punitive, incidental, special, general, exemplary damage or any other kind of damage resulting from or related to the use of the Site, services, software, Contents, whether based on contract, tort, strict liability or otherwise, even if they have been advised of the possibility of said damage, including, without limitations, any loss of benefits, use, data, loss of other intangible property and loss of information security provided in relation to the use of the Site and the services.
If the User does not agree with this limitation clause, the User is kindly invited to exit the Site.
7. Registration Approval.
In order to register in the Site, the User must furnish TLP with some registration data, which must be exact and updated (e-mail address).
The advantages agreed for registration shall be available only after acceptance by TLP of the User’s application for registration. Applications for registration may be denied by TLP at any time without any good cause.
8. Products and Services.
Availability of all products and/or services for quotation and/or sale in all countries, regions or geographic areas is not mandatory.
9. Changes.
TLP may, at any time, amend, suspend or discontinue any aspects of the Site and limit specific characteristics of the Site, or restrict access to any part of the Site or the whole Site without prior notice or liability by TLP. The package design or the product taste or presentation may differ from the picture shown; they may also be altered or discontinued without prior notice.
10. Cancellation.
TLP may, at TLP´s own discretion, cancel or suspend access to any part of the Site or the whole Site for any reason, including, without limitations, non-compliance with these Terms and Conditions of Use.
11. Applicable Law and Jurisdiction.
These Terms and Conditions of Use shall be construed and enforced in accordance with the laws of Argentina.
The User hereby submits to the exclusive jurisdiction of the Ordinary Courts in Commercial matters of the Autonomous City of Buenos Aires in relation to any and all controversies or disputes arising in relation to these Terms and Conditions of Use.
